  8. Software written and distributed by James R. Davis will hereby be
  9. known as DavisWARE.  Any references therein this document to DavisWARE
  10. will mean any software that has been written by James R. Davis and the
  11. copyright notification within the program itself.  
  12.

  18. DavisWARE is Copyrighted by James R. Davis as of July 1993 and is 
  19. covered by US and International Copyright laws.  The author reserves
  20. all rights.

  26. You are granted a limited license to use DavisWARE for a thirty (30)
  27. day period for the purpose of evaluating it for your own use.  After
  28. thirty days, you are required to either register DavisWARE or stop using
  29. it. To continue using it is a violation of copyright laws, and just not a
  30. nice thing to do.

  32. The Shareware versions of DavisWARE are NOT crippled in any way. There
  33. are no missing features or timers.  The only differences between the
  34. registered and unregistered versions of DavisWARE is that the Shareware
  35. version places the word "UNREGISTERED" in the bulletin and displays the
  36. UNREGISTERED logo on the computer screen as part of the copyright
  37. notice. In some unregistered programs, a small feature may not be available.

  41. BBS Distribution
  42. ----------------
  43. BBSs are granted a limited liscense to distribute DavisWARE in a
  44. compressed format.  The distributing BBS is not limited to the type of
  45. compression method used for distribution.  However, the BBS must follow
  46. the following guidelines:
  47.  
  48. 1. If DavisWARE is distributed in a ".ZIP" file, the BBS must preserve
  49.    the "AV" that DavisWARE was compressed with by the author.  If a BBS
  50.    wishes to have DavisWARE sent to them directly from the author, 
  51.    please contact the author and a copy will be sent either by US Mail, 
  52.    or uploaded directly to your BBS.  The sole exception to distribution
  53.    of DavisWARE without the security "AV" placed by the author is where 
  54.    a BBS uses a program to validate their uploads that, as a part of 
  55.    validation, reZIP's the file for maximum compression (not necessary 
  56.    since the distribution archive from the author is created with 
  57.    maximum compression enabled).

  59. 2. No BBS may, in re-ZIPing DavisWARE, add to the ".ZIP" their own "AV"
  60.    which does not belong to the author.

  62. 3. No BBS is authorized to add any files to the archive which are not
  63.    part of the original DavisWARE archive as distributed by the author.
  64.    The sole exception is where a BBS adds an ASCII text file (containing
  65.    no ANSI codes of any type) as an advertisement, and the filename for
  66.    the file has not and/or will not change, and the BBS does not "cycle"
  67.    filenames for the purpose of "fooling" upload checking programs from
  68.    other BBSs which remove such advertisements.

  70. 4. No user may be charged any additional fee just to download DavisWARE
  71.    from the BBS.

  75. Shareware Vendor Distribution
  76. -----------------------------
  77. This copyrighted software and its documentation is NOT PUBLIC DOMAIN.
  78. However, DavisWARE may be distributed at no charge, or for a charge not to
  79. exceed $12 US to cover shipping and media costs.  When secondarily
  80. distributed, DavisWARE must be in its original compressed form and
  81. accompanied by its full documentation.  The distributed software and
  82. documentation may not have been modified in any way.

  85. No secondary distributor is authorized to "register" an individual
  86. copy of DavisWARE.  Registration fees may only be sent directly to the
  87. author as outlined in the manual on disk.  Note that the registration fee
  88. is exclusive of, and over and above any fees that may have been charged by
  89. a secondary distributor.
  90.  
  91. A secondary distributor must notify it's customers that DavisWARE are
  92. shareware programs and that the fee payed by their customer does not
  93. include any fees owed the author for use of this program.
  94.  
  95. A secondary distributor must notify the author of their intention to
  96. include this group of files in their distribution.  A secondary distributor
  97. may be granted exceptions to these conditions, only in writing from the
  98. original author.

  100. The author reserves the right to change any of these conditions without
  101. notice and any changes become retroactive.  Failure to abide by this liscense
  102. agreement may result in either Civil Lawsuit or Criminal charges being filed.

  271. Shipping and Handling charges cover our costs in shipping your order and
  272. tracing delivery problems. We aren't out to make a killing by charging
  273. inflated, nonsensical charges. Here are the charges that must be added 
  274. to each Order (not each Product!):

  284. Once your order has been recieved and processed, you will be mailed
  285. a letter containing your serial number and instructions for using it in 
  286. your configuration file.

  288. Credit Card Orders will be processed within one business day of receipt. 
  289. Other forms of payment will be shipped, typically, 4-5 days after receipt.

  297. shipment. All payments must be made in US funds and drawn on a US
